Terms And Condition

Effective Date: August 15, 2024
Last Updated: August 15, 2026

Welcome to giantmainecoonkitten.com.

These Terms and Conditions govern your access to and use of our website, communications with us, kitten inquiries, reservations, purchases, payments, pickup or delivery arrangements, and related services.

Please read these Terms and Conditions carefully before using our website or making a reservation or purchase.

By accessing this website, submitting an inquiry or application, making a payment or deposit, reserving a kitten, or purchasing a kitten from us, you agree to these Terms and Conditions.

If you do not agree with these Terms, please do not use our website or proceed with a transaction.

1. About Us

Information about Maine Coon kittens, available kittens, upcoming litters, kitten care, reservations, purchasing, pickup, delivery, and related services is provided on our website. Our currently available Maine Coon kittens can be browsed at any time.

2. Eligibility to Purchase a Maine Coon Kitten

You must be at least 18 years old and legally capable of entering into a binding agreement before a kitten can be reserved or purchased from us.

By submitting an inquiry, application, reservation, or order, it is represented by you that:

  • The information provided is accurate and complete.
  • You are legally permitted to own a cat where you live.
  • Appropriate housing, nutrition, veterinary care, companionship, and general care can and will be provided for the kitten.
  • The long-term responsibilities associated with owning a Maine Coon cat are understood.

The right to decline a kitten placement is reserved by us when it is reasonably believed that doing so is necessary for the kitten’s health, safety, or welfare, subject to applicable law.

3. Maine Coon Kitten Availability

Kittens displayed on our website may be listed as:

  • Available
  • Reserved
  • Pending reservation
  • Sold
  • Temporarily unavailable
  • Part of an upcoming litter

Availability can change quickly and is not guaranteed until the applicable reservation requirements have been completed and confirmed by us. Furthermore, a kitten is not automatically reserved when an inquiry or application is submitted, and kitten availability may be updated by us without prior notice.

4. Kitten Information

Reasonable efforts are made by us to provide accurate information about each kitten, including details that may relate to:

  • Breed
  • Sex
  • Date of birth
  • Coat color
  • Pattern
  • Parentage
  • Current size
  • Personality or temperament observations
  • Vaccination or veterinary information
  • Availability

Because kittens are living animals that continue to grow and develop, some characteristics may naturally change over time. Photographs and videos are intended to represent the kitten as accurately as reasonably possible; however, appearance may vary because of lighting, photography, age, grooming, growth, or differences in displays and devices.

5. Adult Size and Appearance

Maine Coons can vary substantially in adult size, weight, coat development, appearance, and physical characteristics. In fact, Maine Coons are among the largest domesticated cat breeds, which is part of what makes their eventual size difficult to predict precisely.

Any statements about expected adult:

  • Weight
  • Height
  • Length
  • Coat
  • Color development
  • Facial structure
  • Ear development
  • Overall size

are considered estimates unless expressly guaranteed in a separate written agreement. It is not guaranteed by us that a kitten will reach a particular adult size, weight, appearance, or physical measurement unless such a guarantee is expressly stated in writing.

6. Temperament and Personality

A kitten’s observed temperament may be described by us based on its behavior while in our care. However, behavior can be affected by:

  • Age
  • Environment
  • Socialization
  • Training
  • Household conditions
  • Other animals
  • Children
  • Stress
  • Health
  • Adjustment to a new home

For these reasons, it cannot be guaranteed that a kitten will maintain a specific personality or behavior throughout its life. Proper introduction, socialization, veterinary care, enrichment, and responsible handling remain important after the kitten enters its new home.

7. Kitten Applications

Prospective buyers may be required by us to complete an application or provide information before a kitten is purchased. The purpose may include helping us understand:

  • Your household
  • Your experience with cats
  • Whether you have other pets
  • Your preferred kitten
  • Your living environment
  • Your plans for caring for the kitten
  • Your pickup or delivery requirements

Please note that approval or reservation of a particular kitten is not guaranteed when an application is submitted, and additional information may be requested by us when reasonably necessary.

8. Reservations

A kitten is considered reserved only after the reservation has been confirmed by us and any required reservation payment or deposit has been received. A verbal conversation, website inquiry, email, text message, or application alone does not necessarily constitute a confirmed reservation. Additionally, reservation requirements may vary depending on the kitten, litter, or specific agreement.

9. Deposits

A deposit may be required by us to reserve a kitten. Before a deposit is accepted, applicable deposit terms should be communicated to the buyer, including whether the deposit is refundable, non-refundable, transferable, or subject to particular conditions.

Where a deposit is expressly identified as non-refundable before payment, it may be treated as non-refundable to the extent permitted by applicable law, because the kitten may be removed from availability for other prospective buyers. If separate written reservation terms are provided for a specific kitten, those terms will apply to that reservation. Nothing in these Terms limits any refund or cancellation rights that cannot legally be waived.

10. Pricing

Prices may vary depending on factors such as:

  • Kitten
  • Litter
  • Age
  • Sex
  • Coat color or pattern
  • Pedigree
  • Intended placement
  • Transportation requirements
  • Additional services

The applicable price will be the price communicated or displayed for the particular transaction, subject to correction of genuine errors. Additional expenses such as transportation, delivery, carrier services, veterinary requirements, documentation, or other agreed services may be charged separately. Applicable charges will be disclosed by us before the transaction is finalized wherever possible.

11. Payments

One or more payment methods may be accepted by us, as communicated during the purchasing process. You agree to provide accurate payment information and to make payments according to the payment instructions provided for your transaction.

A kitten will not be considered fully paid until all required funds have been successfully received and confirmed. You are responsible for checking payment details carefully before funds are transferred. If payment instructions are received that appear inconsistent with previous communications, please contact us directly at info@giantmainecoonkitten.com before payment is made.

12. Final Payment

Unless otherwise agreed in writing, any remaining balance must be paid according to the payment schedule communicated for the transaction. Failure to make the required payment within an agreed deadline may result in cancellation of the reservation, subject to the specific reservation agreement and applicable law. The treatment of any previously paid deposit will be governed by the deposit terms disclosed for that transaction.

13. Cancellations by the Buyer

If you decide not to proceed with a reservation or purchase, please contact us as soon as possible at info@giantmainecoonkitten.com.

Any refund, credit, transfer, or forfeiture of a deposit will depend on:

  • The terms disclosed when the reservation was made
  • Whether a payment was designated refundable or non-refundable
  • Expenses already incurred
  • The stage of the transaction
  • Applicable law

14. Cancellations by Us

The health and welfare of our kittens are important to us. A sale or delivery may be canceled or postponed by us when reasonably necessary because of circumstances such as:

  • Veterinary concerns
  • Illness or injury affecting the kitten
  • A kitten being determined not ready to leave
  • Transportation problems
  • Incorrect information materially affecting the placement
  • Concerns regarding the kitten’s safety or welfare
  • Circumstances outside our reasonable control

If a transaction is permanently canceled by us and the agreed kitten cannot be provided, payments will be handled according to the applicable written agreement and applicable law.

15. Health of Maine Coon Kittens

Reasonable steps are taken by us to care for kittens while they are in our possession. Health information provided for a particular kitten may include available veterinary, vaccination, deworming, or other health records.

Because animals are living beings, no animal can be guaranteed to remain free from every illness or medical condition throughout its life. Any specific health guarantee associated with a kitten must be stated in a separate written agreement or expressly included in the transaction documents.

16. Veterinary Examination After Receiving a Kitten

Buyers are strongly encouraged to establish a relationship with a licensed veterinarian and to arrange an appropriate veterinary examination after their kitten is received. Prompt veterinary care can help establish a health record and allow the buyer to discuss:

  • Vaccination schedules
  • Parasite prevention
  • Nutrition
  • Growth
  • Spaying or neutering
  • Preventive healthcare
  • Breed-specific considerations
  • Any immediate health concerns

For general guidance on preparing for your new arrival, our tips on bringing your kitten home may be helpful. If a separate health guarantee establishes a particular examination deadline, the requirements of that written health guarantee should be followed by the buyer.

17. Health Guarantees

If a specific written health guarantee is provided with a kitten, that document forms part of the purchase terms for that kitten. The separate health guarantee may establish:

  • Covered conditions
  • Excluded conditions
  • Veterinary examination requirements
  • Documentation requirements
  • Claim procedures
  • Applicable time periods
  • Available remedies

In the event of a conflict between these general Terms and a specific written health guarantee regarding a covered health matter, the specific health guarantee will control to the extent permitted by law.

18. Veterinary Costs After Transfer

Unless otherwise required by a written health guarantee or applicable law, buyers are generally responsible for routine and ongoing veterinary expenses after possession of the kitten is taken. These may include:

  • Examinations
  • Vaccinations
  • Parasite prevention
  • Medication
  • Emergency treatment
  • Spaying or neutering
  • Dental care
  • Routine preventive care

Any responsibility that is expressly accepted by us for particular veterinary costs must be established in writing.

19. Pickup

If your kitten is to be picked up, the date, time, and location should be arranged in advance. You may be required to provide:

  • Your name
  • Identification
  • Reservation information
  • Confirmation of final payment

An appropriate and secure cat carrier should be brought by buyers unless otherwise arranged.

20. Delivery and Transportation

Where available, transportation may be arranged through methods such as:

  • Ground transportation
  • Pet transportation services
  • Flight nanny services
  • Airline arrangements
  • Other appropriate delivery methods

Availability depends on the buyer’s location, the kitten’s age and condition, transportation provider requirements, weather, routing, and other relevant factors. Delivery fees may be charged separately from the kitten purchase price.

21. Delivery Estimates

Any delivery date or arrival time provided before transportation is completed is considered an estimate unless expressly agreed otherwise. Delays may occur because of circumstances outside our reasonable control, including:

  • Weather
  • Flight changes
  • Carrier delays
  • Transportation disruptions
  • Veterinary concerns
  • Regulatory requirements
  • Safety concerns
  • Emergencies

Reasonable efforts will be made by us to communicate material changes concerning an arranged delivery.

22. Kitten Welfare During Transportation

Transportation arrangements should prioritize the kitten’s health and safety. Transportation may be postponed by us if it is reasonably determined that travel conditions could create an unnecessary risk to the kitten. This may include extreme weather, illness, transportation disruptions, or veterinary advice.

23. Transfer of Responsibility

Responsibility for the kitten generally transfers to the buyer when the buyer or the buyer’s authorized representative takes possession of the kitten, subject to any rights and responsibilities provided in a separate written agreement or required by law. After possession is taken, the buyer is responsible for providing appropriate:

  • Food and water
  • Housing
  • Veterinary care
  • Safety
  • Grooming
  • Exercise and enrichment
  • Socialization
  • Supervision

24. Buyer’s Responsibilities

By purchasing a Maine Coon kitten, you agree to provide responsible lifetime care. This includes maintaining appropriate:

  • Nutrition
  • Fresh water
  • Veterinary care
  • Vaccinations as recommended by your veterinarian
  • Parasite prevention
  • Grooming
  • Safe housing
  • Socialization
  • Exercise and enrichment
  • Emergency medical care when needed

You are responsible for complying with applicable laws and regulations concerning pet ownership in your location.

25. Introducing the Kitten to a New Home

A kitten may experience stress when a new environment is entered. Therefore, an appropriate adjustment period should be provided by buyers, and the kitten should be introduced gradually to:

  • New family members
  • Children
  • Other cats
  • Dogs
  • New rooms
  • New foods
  • New routines

If concerns regarding behavior or health arise, an appropriate veterinarian or qualified animal professional should be consulted.

26. Food and Diet Changes

Sudden changes in diet may cause digestive upset in some kittens. If the kitten’s food is to be changed, an appropriate transition should be discussed with your veterinarian. We are not responsible for health issues caused by inappropriate feeding, unsafe foods, neglect, or failure to obtain appropriate veterinary care after transfer, except where responsibility cannot legally be excluded.

27. Breeding Rights

Unless breeding rights are expressly included in a written purchase agreement, no representation should be assumed regarding breeding eligibility. If breeding rights are offered, any applicable conditions, registration provisions, pricing, and restrictions should be documented separately.

28. Registration and Pedigree Documentation

Where registration, pedigree, or other documentation is included with a particular kitten, the specific documents to be provided will be identified as part of that kitten’s transaction. Not every kitten or purchase necessarily includes the same documentation. Please do not assume that a particular registration or pedigree document is included unless it has been expressly stated.

29. Accuracy of Website Information

Reasonable efforts are made by us to maintain accurate website content. However, occasional errors may occur regarding:

  • Pricing
  • Availability
  • Dates
  • Descriptions
  • Photographs
  • Specifications
  • Website functionality

Genuine errors may be corrected by us when they are discovered. If an error materially affects an existing transaction, efforts will be made to communicate it to the affected buyer and to address the matter in accordance with applicable law.

34. Fraud Prevention

Reasonable steps may be taken by us to verify transactions and protect buyers, kittens, and our website against suspected fraud or unauthorized activity. Additional verification may be requested if unusual or potentially fraudulent activity is detected. Transactions may be paused or declined when reasonably necessary for fraud prevention, subject to applicable law.

35. No Veterinary Advice

Information provided on our website concerning cats, kittens, feeding, grooming, health, or general care is intended for general informational purposes. It is not a substitute for diagnosis, treatment, or advice from a licensed veterinarian. For questions about your kitten’s health, a qualified veterinarian should be consulted. Additional breed-specific health guidance is available through resources such as the American Veterinary Medical Association.

36. Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or similar damages resulting solely from your use or inability to use this website. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Any rights provided to consumers by applicable law remain unaffected.

37. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or expenses arising directly from your unlawful use of our website, your violation of these Terms, or your infringement of the rights of another person. This provision does not require you to indemnify us for conduct for which liability cannot lawfully be shifted to you.

38. Force Majeure

We are not responsible for delays or failures caused by events outside our reasonable control, to the extent permitted by law. Such circumstances may include:

  • Severe weather
  • Natural disasters
  • Transportation interruptions
  • Airline cancellations
  • Government restrictions
  • Public health emergencies
  • Power or internet outages
  • Labor disruptions
  • Other unforeseen events beyond reasonable control

Where such an event affects a kitten’s transportation or transfer, the kitten’s welfare and safety will be prioritized.

41. Separate Purchase Agreements

A separate kitten purchase agreement, health guarantee, reservation agreement, or other transaction-specific document may be used by us. If such a document is provided and signed or otherwise accepted, it forms part of the agreement relating to that transaction. If a transaction-specific agreement conflicts with these general Terms regarding that specific transaction, the transaction-specific agreement will generally control, subject to applicable law.

42. Governing Law

These Terms are governed by the laws applicable in the State of Texas and the United States, without limiting any mandatory rights or protections you may have under applicable consumer protection law.

43. Dispute Resolution

If a disagreement arises concerning a reservation, purchase, delivery, or use of our website, you are encouraged to contact us first so that the matter can be resolved directly.

44. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain effective to the extent permitted by law. The affected provision will be interpreted or limited only to the extent necessary to make it enforceable where legally permissible.

45. No Waiver

If a provision of these Terms is not immediately enforced by us, that does not necessarily mean the right to enforce that provision later has been waived.
